While most DUI charges are classified as class A misdemeanors, some are classified as felonies. Whenever you face felony charges, it's important to contact an experienced defense lawyer as soon as possible. No one would want to go through life with a felony conviction on his or her record.
Attorney Philip R. Nathe at our firm has the skills and experience to help you avoid a felony conviction if that is possible. Mr. Nathe has more than 30 years of experience in the DuPage County criminal justice system. Contact us today for a free initial consultation to discuss your case.
Illinois Aggravated DUI Charges
In Illinois, any DUI offense resulting in felony charges is classified as aggravated DUI. Examples of aggravated DUI charges include:
- A first DUI offense that results in an accident causing bodily harm to a child under age 16
- A second DUI offense if committed while transporting a child under age 16
- A third or higher DUI offense
- DUI committed without a valid driver's license or permit
- DUI committed without vehicle liability insurance
- DUI committed while revoked or suspended for DUI, reckless homicide or leaving
the scene of an accident
- DUI resulting in great bodily harm, permanent disability or disfigurement
- DUI resulting in a death
Aggravated DUI may be charged as a class four, class three or class two felony, depending on the circumstances. Conviction of a class four felony is subject to possible imprisonment of one to three years and fines of up to $25,000. Class three and class two felonies can result in significantly longer prison sentences. As a convicted felon, you would lose the right to vote and to possess weapons. You would also find it difficult to obtain a job, since criminal background checks are commonplace.
As your lawyer, Mr. Nathe will pursue all possible defenses, including negotiating a reduction to misdemeanor DUI charges. If necessary, we can challenge the state's case in court.
